I missed the other thread (I only read a fraction of what gets posted here) but I think it's very iffy, because if you can copyright an arpeggiated chord progression then we're all in trouble. There is an audible similarity between the songs, but it's a chord progression.
The Gaye vs. Thicke case was even worse, that was rhythm and "feel" that was deemed to be similar. Noel Gallagher summed it up pretty well: "Are we talking about a cowbell?"
