  • Excellent article, I hope @analog_matt follows through on this. I also filed a complaint on Apple’s official feedback page about this issue and how they need to change the App Store so users have a mechanism for reporting these scam artists.

They sell it and hence have a legal responcibility for it. Not sure how the laws go in usa, but if i were to sue apple, i would do it from my country and apple would need to comply to my countrys laws as they sell the product in my country and laws in usa are irrelevant.

    This is correct.

I would also refer the forum to the recent change of heart, whereby Apple stopped issuing legally unenforceable notices to UK (and likely elsewhere) App Store customers, telling us that we could not get a refund.

Under UK law, not only can stuff sold at a distance by a company be returned simply because the customer doesn’t like it, but if goods are ‘not fit for purpose’ then a refund is the purchasers right.

In reality, very few customers take the piss by returning goods just for the hell of it, and only return stuff if it actually doesn’t work. So by sending out intimidating and meaningless notices Apple were not doing themselves any favours. It looks like, eventually, someone realised this. :)

That stopped after we both had a rant about it, I did some digging, found something in the UK legislation suggesting the message could potentially mislead customers, and posted it on here.

Now I’m not saying I’m personally responsible for changing their store behaviour, but you never know who’s reading this stuff, and whether other bods run with it.

I’m still not getting that message.

The point is, any complaint is worth making, and can start the ball rolling and get things sorted.

I’m sure if this guy had ripped off GarageBand they’d do something about it.

Yep, the message does not appear. It may well have been coincidence, or just as likely someone was watching, and saw a quick fix that did the right thing. I must admit that not getting those irritating notices has actually encouraged me to buy a few more apps. (-:

You are also quite right to point out that Apple would not take one moment of anyone selling a Garage Band clone, so maybe all it needs is enough noise made. It is surely a win-win for Apple to come down hard of those stealing from Analog Matt. The little guy is helped out, and the big corporation gets to show it cares. Everyone goes to bed with a smile...except for the pirates.
