Great news! I think common sense is coming back to the courts since the Gaye vs Thicke fiasco.
You could not be more correct; in my line of work I get to see behind the scenes in the corporate world, and it's not who will be watching us - they are now and couldn't be happier. This world of social media is like a dream come true to marketing pros, every faceb*k post is a piece of data corps used to have to pay plenty of bucks for, now being served up free and willingly.
But who watches the watchers, when that solution takes place the social revolution that is underway will near fruition.

What I did was to re-read my post, and found out it was overly agressive and way out of tone. For that I sincerely apologise.
That said, my point - and I stand by it - is that you compared two situations that are completely different. Led Zeppelin wasn't sued for sampling, but for a stupid charge of plagiarism based on a chord progression. Were you following this particular situation? The veredict was sort of a statement against copyright trolls (usually people that never create anything).
By the way, back to the topic, the german court decision didn't entitle anyone to use the work of others free of charge - and by no means it void any copyrights. It just nulls the need for an authorization by the original author. I had already read all your posts on the subject and I must say I disagree with your opinion: the german ruling was reasonable as it protects both the rights of the author of the original work and of the derivative work.
I find that completely unacceptable. It means an artists work, that was written to promote or reflect their own particular passion or point of view, can be used, without permission by other artists promoting a completely opposing view. That's a complete lack of respect for the feelings and rights of the original artist.
That's the risk and price of sucess, @carol. You made your point quite clear: we simply won't agree on this.
What's it got to do with success? An artist of any stature can have their work taken and used without their permission. How is that ok? If you were a Christian, or Jew would you be happy if a satanist or neo-nazi group paradied your work? Or your pro-gay song was used by a homophobic rapper to completely distort your original message?
How can that possibly be ok?
Would it be ok for me to setup a band called 'Death to Fags' and put out a Cd of Elton John covers? Really?
I have respect for artists themselves - not just the work they create. As artists and musicians we should respect and support the wishes if our fellow artists. It's not just about 'product'. We're not manufacturing tins if baked beans FFS

we will never agree on this. I think its the later.
All in all I think copyright, patents, and actually any kind of private property will kill human kind with its own hands.
Surplus, accumulation and any pretended right on those are just dumb and reactionary towards any real progress.
This is specially true when talking about intellectual property; absolutely working against the reasons why human kind is the only animal with such powers we as humans have over our ecosystem.
If we can communicate and transmit knowledge is just because millions of humans before us built a language system in several lifetimes. If anyone would ever claim a right on this or that word we would be still barking.
Fortunately, deep in our souls, we know we can't stop it.
Fight club, reservoir dogs, casino, all great movies I have the utmost respect and admiration for and own digital copies, as well as original DVDs vhs, but if I sample one bit of that its thievery?! You my friend are one of those people....I changed my mind I texted Brad Pitt and he said "the things you own end up owning you" I say fuck it. I am always sampling scenes from movies to set the mood in tracks I make no profit for. I'll flip the script and write a story where one of the other people die that didn't die in the movie. It's called creativity. No I don't sell them, I do it because it's fun to sample movies. Whoever made the point on samples from presets and demo songs was spot on as well.
under this court ruling, the artist would still be protected. What is allowed is to take a tiny bit of blip or clack and reuse it. Meaningfull artistic expressions are still protected.
