Well, Apple has been sued. Let's see how that unfolds.
What is right or wrong is not a fact mostly. It´s in the eye of the beholder.
I know a neighbor who has a cousin who knows someone who says Apple just want our best. So it must be true.
Apple has already done this for iPhones with their iPhone Upgrade Program.
If they are taking a specific action based on that information, then they need to inform the user with a system notification just as they do when they want a user to update to the next iOS version, with the same consistency and repetition.
That specific act of intentional throttling because of the state of the battery without notification is the issue. The battery obviously needs replaced in that situation. If they can take the action of increased throttling, they should easily be able to take the action of notifying the user when they are doing it and explaining why.
They will likely face more than just this lawsuit, and can expect regulatory action on top of that if they don't act quickly.
The good news is that the fix is just as easy as what I described, notification when the OS recognizes the need for extra throttling because of the state of the battery.
The problem for Apple is they might have to replace many batteries at their own cost.
I am quite sure that they don't have to.
My android battery can be easily swapped. Now I know why iOS phones and iPad batteries are impossible by the end user to be replaced.

Apple knows what is best. They invented the microcomputer, they invented the graphical operating system and mouse (Xerox PARC copied THEM:)
Seriously though, in recent years Apple's legacy is rapidly changing from the producer of innovative, revolutionary , quality products to just another greedy corporation whose sole goal is to extract as much money from consumers as possible by any means necessary.
5 points, which are important for most users (imho):

CPU throttling does not affect devices with intact batteries and usually don't reduce the average speed of your device. It does reduce the maximum speed, indeed.

The idea is NOT to make you buy a new iPhone (then it would work quite different), but to prevent sudden turnout of devices (which is a safety feature helping you not to see a burning iPhone or an exploding iPhone) with remaining battery life. Additionally it helps the users to get a longer battery life - and it really helps the remaining health of the battery.
When LiPo batteries get depleted, then they change their behavior and they cannot (!) offer so much energie at once. It is a bit like with humans: When we get old (or: very old) we usually have less energy to offer.
iOS (and CPU) throttling just reacts to this. This is NOT bad will by Apple*. And, yes, it is a good idea to exchange a depleted battery.

iPads are NOT affected from CPU throttling. iPod Touch devices are not affected by CPU throttling. iPhone 5s or older, iPhone 8 or iPhone X are not affected, too. Oh, and it is extremely unlikely that your iPhone SE or iPhone 7 is affected.

I’m surprised to hear that. My 5s just turned 4 and the only reason I haven’t replaced it because the battery is so bad is I only use it for phone and text these days.

What is your evidence on this? You don't know whether Apple's agenda is to push you towards the new phone, or not. After all, they are on the market not to spread love, but to make money. So, I'd wager throttling's intentional side-effect is to force the user to ditch the old phone and buy the new one.
What evidence do you have about the things i know and the things i don't know? Even thinking that i don't know a thing (this is very OK for me - and more OK than thinking different - i actively welcome this):
Don't you think Apple would create a different method than throttling CPU peaks (and making it even depending to charging status, temperature, geographic location and other things)? It would be much smarter (for the bad agenda) to throttle AVERAGE CPU insteald of throttling only CPU peaks or even better, to increase the rate of sudden turnoff of your devices. They could even create "issues" with your display, or the increasing latency of your device. They could be MUCH smarter to get you think that you need a new device.
The smartest way, imho: They just could avoid any iOS update in case your device is older than 18 months (this is the way of some Android devices). This would reduce costs. Better idea!
If they have a bad agenda, it would look quite different than doing some CPU peak throttling.
How often you have seen a sudden turnoff of your device? In the very seldom case you have issues like this on a regular basis: Did you notice that the version of iOS influences this behavior? Are you more happy with more sudden turnouts?
Maybe this is really suprising: LiPo batteries get older. When they get older (and used) they change their behavior. Usually this behavior starts with about 300 complete charging cycles or such. Usually this behavior develops into a real issue for your iPhone after 600 cycles. For example: The get warmer when they charge. Oh, and they can't offer so much power at the same time. When they have - for example - 3,75 Volt they can't offer the same Ampere (compared with a new battery). Really strange, isn't it? As a result bad batteries prevent your device to run on full CPU speed. Really strange, isn't it? Even more strange: iOS reacts to the different behavior of old/depleted batteries. Why does Apple do this? Why???
Because they are bad! They just want to ruin their customers!!! This must be the correct explanation. Yeah!
Then i would assume that your 5s has had a life with a big workload (that means: > 1000 charging cycles) of it have too often seen a charging state of below 20 percent (or even lower) remaining battery life - which indeed reduces battery health in the long run.
A well known "trick" to achieve a better battery life of your device is to prevent it to get below 20 percent charging state.
(this "trick" works with all - ! - LiPo batteries)
It shouldnt be too expensive and too complicate (be careful!) to change the battery of an iPhone 5s. When the old battery really is dead (or: nearly dead) you can try this one:

The quality of these replacement batteries usually isn't so good (even a very old and almost depleted iPhone battery sometimes outperformances them) - but for 10 bucks? Better than nothing.

Is there such a thing as “average CPU speed” and how do you measure that?
I’m having difficulties with understanding this notion, if it is not affected by the “max CPU speed” as you claim.
The devil always is in the details. The more you look into the details the more complicate it gets. Depending on your usage CPU peak throttling can reduce average CPU speed: a bit.
Playing two instances of Model 15 on an iPhone 6s: CPU peak throttling would affect this (in case of a battery with reduced capacity - and additionally some other circumstances).
For us, usually using iPads (or modern iPhone devices):

The thing is also that Apple doesn´t said that....but after the rumor was true they had to say something about it.
Of course all big companies want to please their share holders first because making money is the most important goal.
Apple seems still to have a lot hardcore fans but i agree that the magic is a bit gone in the last years.
I also wouldn´t buy another iPhone again but still think mac is better than PC......but that might change too since the latest macbook pro are too much consumer tools rather than really powerful working machine.
If i don´t would like Logic soo much and some iOS music apps i had switched for some years already.
The thing with iOS devices is you can´t take all your tools and migrate to another platform/brand without loosing that all.
Believe me i never thought i would say that but i think microsoft is the more innovative company right now and alone the iPhone X shows me what i don´t like where Apple goes.
The iPads are indeed still great tablets and if i ever would feel the need for a tablet i still think iPads are the best.
Otherwise Apple doesn´t stand out in any way which they did for me some years ago.
The really high prices are also things i might can´t catch up further in the future.
I mean i´m for a upgrade on my macbook but i had to pay about €3000. Even iPads and iPhones (if you need more space and want the latest and greatest) cost you over a grand.
I prefer to spend more for good music apps and plug-ins

Your definition of “us” obviously does not include me, as I’m using 2xSE’s and a 6 in my setup. Together with an Air2 and a mini2.

I don't think you are affected. There is a great thing with your iPhone 6: It has a kind of a really good working CPU peak throttling built in...

The other devices are safe - your two iPhone SE maybe only for the next 18 months. If the batteries depletes the iPhone SE maximum CPU speed may will denerate (depending to your usage) into a device which can't handle the same number of CPU peaks (compared to a new iPhone SE). Translate this into: Less instances of Model 15. To be clear: Maybe.
